Medical Cannabis: Who Qualifies?
Thank you to all South Dakota residents who voted ‘yes’ to the legalization of medical cannabis in 2020! Eighteen months later, South Dakota and its residents were allowed to begin reaping the benefits of these election results. Unsurprisingly, the most frequently asked question is what qualifies a person to legally use medical cannabis. Per the State of South Dakota (as referenced on medcannabis.sd.gov) a patient is allowed to use medical cannabis if they have a
“debilitating medical condition,” which is defined by SDCL 34-20G-1 as “a chronic or debilitating disease or medical condition or its treatment that produces one or more of the following: cachexia or wasting syndrome; severe, debilitating pain; severe nausea; seizures; or severe and persistent muscle spasms, including those characteristic of multiple sclerosis”.
The verbiage can be a little tricky but our motto is pretty simple: it never hurts to ask! To obtain a medical cannabis card in South Dakota, begin the process by talking with a provider.
